What are the most common visa types?

What is the typical timeline for the immigration process?
1-4 weeks pre-arrival and 1-2 weeks post-arrival.
How long does it take to collect information and submit the application?

What is my duration of stay?
The employment visa is generally issued with an initial validity of up to 5 years. The FRRO residence certificate is issued with a 1 year duration. Renewals are possible for both documents.
How soon can employees start working?
Immediately after arrival date.
Is there a quota for the number of transferees that can apply?
No.
Is there expedited processing available for applications? Are there extra fees?
No.

Will documents require translation, apostilles, and/or legalization?
All documentation must be presented in English or with a certified translation.
What is the requirement for the application location?
Outside of India in home country, but FRRO registration occurs following entrance.
Is set-up/sponsorship registration needed for transferees by their employers?
Yes.

  • Employment contract or assignment letter

  • Certificate of incorporation
When do I renew my work visa?
5-6 months prior to the visa expiration date. If the visa is issued for a maximum of 5 years, then renewal should begin around 4.5 years following its issuance.
Can dependents work under the registration process? If so, do they have limitations and requirements to do so?

Spouse or partner employment access is not permitted via the dependent pass. Family members other than the spouse or partner also do not have access to employment via the dependent pass.

Are same-sex spouses considered dependents?
Same-sex spouses are not recognized as dependents in India.
What, if any, deregistration requirements are required?
FRRO residence certificate must be surrendered upon final departure at the point of exit.
What are the red flags and/or special criteria?
  • Highly skilled or professional job requirement 
  • All transferees must pay Indian taxes.
  • Salary thresholds are enforced.
  • Immigration practice and policy vary by location.
